GENEVA (14 January 2025) – The UN Special Rapporteur on the right to education, Catherine Ameline, today welcomed a recent US court ruling which reaffirmed sex-based protections in education.
“This ruling is an important victory for the rights of all students, regardless of their sex or gender identity,” said Ms. Ameline. “It ensures that all students have the right to a safe and inclusive learning environment.”
The case in question was brought by several parents and students who argued that a school district policy allowing transgender students to use the restroom that corresponds with their gender identity violated their privacy rights.
The court ruled that the school district’s policy was a reasonable accommodation of the needs of transgender students and did not violate the rights of other students.
“This ruling is consistent with international human rights law, which requires States to take all necessary steps to ensure that all students have equal access to education,” said Ms. Ameline.
