Rights experts call for immediate release of Abu Zubaydah from Guantánamo
GENEVA (8 January 2025) – UN human rights experts* have called for the immediate release of Abu Zubaydah, a Palestinian man who has been detained without charge at the US naval base in Guantánamo Bay, Cuba, for nearly two decades.
Zubaydah was captured in Pakistan in 2002 and has been held in Guantanamo ever since. He has never been charged with a crime and has been repeatedly subjected to torture and other cruel, inhuman or degrading treatment.
In a statement released today, the experts said that Zubaydah’s continued detention is “a grave violation of his human rights” and that he should be released “without further delay.”
“Mr. Zubaydah has been held for nearly 20 years without charge or trial,” the experts said. “He has been subjected to torture and other cruel, inhuman or degrading treatment, and his health has deteriorated as a result.”
The experts said that Zubaydah’s detention is “a clear violation of international law” and that the US government has “failed to provide any credible justification for his continued detention.”
“We urge the US government to release Mr. Zubaydah immediately and to provide him with the necessary medical care and rehabilitation,” the experts said.
The experts also called on the US government to “close Guantanamo Bay and to end the practice of arbitrary detention.”
“Guantanamo Bay is a symbol of injustice and abuse,” the experts said. “It is a place where people have been held for years without charge or trial, and where they have been subjected to torture and other cruel, inhuman or degrading treatment.”
“The US government must close Guantanamo Bay and end the practice of arbitrary detention,” the experts said. “It is time to uphold the rule of law and to respect the human rights of all people.”
*The experts: Fionnuala Ní Aoláin, Special Rapporteur on the promotion and protection of human rights while countering terrorism; Nils Melzer, Special Rapporteur on torture and other cruel, inhuman or degrading treatment or punishment; Morris Tidball-Binz, Special Rapporteur on extrajudicial, summary or arbitrary executions; and Leigh Toomey, Chair-Rapporteur of the Working Group on arbitrary detention.
