1. Introduction

This Order is made by Denbighshire County Council in exercise of its powers under sections 14(1) and (2) of the Road Traffic Regulation Act 1984, as amended, and of all other enabling powers and after consultation with the Chief Officer of Police in accordance with the requirements of section 14(3) of the Road Traffic Regulation Act 1984.

2. Interpretation

In this Order –

“the A55 Trunk Road” means that length of the A55 trunk road in the County of Conwy and Denbighshire bounded by a point on the A55 Trunk Road at its junction with the B5109 road at Faenol Interchange, Conwy, and a point 50 metres east of the B5106 road at Talardy Interchange, Denbighshire;

“Authorised Person” means any person acting on behalf of the Council as their agent for the purposes of this Order;

“the Council” means Denbighshire County Council;

“motor vehicle” is as defined in Section 194 of the Road Traffic Act 1988;

“road” means a highway maintainable at the public expense and includes any part of a highway so maintainable;

“vehicle” means a vehicle as defined in section 192 of the Road Traffic Act 1988;

“emergency services vehicle” means a vehicle which is being used for fire fighting, ambulance or police purposes or for the purposes of the special services mentioned in Section 87 of the Civil Contingencies Act 2004;

“pedestrian” means a person on foot;

“cyclist” means a person who is riding a bicycle;

3. Prohibition of vehicles, cyclists, and pedestrians

(1) No person shall cause or permit—

(a) any motor vehicle to proceed along a length of the A55 Trunk Road as specified in Article 7 and Schedule 1; or (b) any pedestrian or cyclist to proceed along a length of the A55 Trunk Road as specified in Article 7 and Schedule 1;

otherwise than in accordance with the restrictions specified in Article 4 of this Order.

(2) The prohibitions contained in paragraph (1) do not apply—

(a) to any person engaged in the carrying out of the relevant works; (b) to any vehicle being used for police, fire brigade or ambulance purposes; (c) to any vehicle which is being used in connection with the maintenance or improvement of the A55 Trunk Road; (d) to any vehicle which is used for undertaking essential statutory duties; (e) to any vehicle which is being used for the removal of any obstruction to traffic; (f) to any vehicle being used in the service of a statutory undertaker in the exercise of the undertaker’s functions; (g) to any vehicle in respect of which the Council has granted permission in writing; (h) to any vehicle travelling for the purpose of accessing premises adjacent to the A55 Trunk Road; or (i) to any emergency services vehicle.

4. Restrictions on vehicles

(1) All motor vehicles except those referred to in Article 3(2)(a) and (b) shall proceed along the eastbound carriageway of the A55 Trunk Road between Junction 24 (Faenol Interchange), Conwy and Junction 27 (Talardy Interchange), Denbighshire in an easterly direction only.

(2) All vehicles shall proceed along the A55 Trunk Road at a maximum speed of 20mph between Junction 25 (Rhuallt Interchange), Denbighshire and Junction 26 (Llanfairfechan Interchange), Conwy only.

5. Temporary diversion

(1) Where vehicles are prohibited from proceeding along the length of the road specified in Article 7 and Schedule 1 as a consequence of this Order, traffic will be diverted through the alternative route specified in Schedule 2.

(2)  Traffic from the A55 eastbound, travelling eastbound towards Junction 27 (Talardy Interchange), will be diverted via Junction 25 (Rhuallt Interchange) and the B5381 road to re-join the A55 eastbound at Junction 27 (Talardy Interchange).

6. Works

(1) The prohibition of vehicles, cyclists, and pedestrians, and the restrictions on vehicles, imposed by this Order are necessary to enable the Council to undertake the following works:

(a) to undertake resurfacing of the road; (b) to undertake bridge joint replacements; (c) to undertake traffic signal mast replacements; (d) to undertake traffic signal detector works; and (e) to undertake road lighting works.

(2) The works will be undertaken between the hours of 0800 hours and 1900 hours and are expected to be completed on or by 10th September 2024.

7. Road closure

(1) The length of the A55 Trunk Road in the County of Denbighshire which will be subject to the prohibition and restrictions contained in this Order is as follows:

A length of the A55 Trunk Road between Junction 24 (Faenol Interchange), Conwy and Junction 27 (Talardy Interchange), Denbighshire – to a distance of 1150 metres in a south-easterly direction from the eastern boundary of the A55 Trunk Road at the junction with the B5109 at Faenol Interchange, Conwy.

8. Penalties

Any person who fails to comply with an Order commits an offence and is liable on conviction to a fine not exceeding level 4 on the standard scale.

9. Revocation

The A55 Trunk Road (Eastbound Carriageway between Junction 24 (Faenol Interchange), Conwy & Junction 27 (Talardy Interchange), Denbighshire) (Temporary Prohibition of Vehicles, Cyclists & Pedestrians) Order 2024 is revoked.
