CMA sets out initial plans as new digital markets competition regime comes into force

The Competition and Markets Authority (CMA) has today set out its initial plans for implementing the new digital markets competition regime, which comes into force today.
The new regime gives the CMA powers to designate companies with ‘strategic market status’ (SMS) if they have substantial and entrenched market power in a particular digital market. Once a company has been designated with SMS, the CMA will be able to impose a range of pro-competition measures on the company, including:
- Requiring the company to provide access to its data to rivals
- Preventing the company from engaging in certain anti-competitive practices
- Breaking up the company if necessary
The CMA is currently considering which companies to designate with SMS. The CMA expects to make its first designations by the end of 2025.
The CMA’s Chief Executive, Andrea Coscelli, said:
“The new digital markets competition regime is a world-leading framework for regulating digital markets. It will give us the tools we need to ensure that these markets are competitive and that consumers get a fair deal.”
“We are committed to implementing the regime effectively and fairly. We will work closely with businesses, consumer groups, and other stakeholders to ensure that the regime delivers the benefits it is intended to.”
