Experts Welcome Arbitration Reform Despite Objections
Bonn, December 4, 2024 (hib) – The German Arbitration Association (DIS) has welcomed the planned reform of arbitration proceedings. “The reform will significantly strengthen arbitration as a modern and efficient dispute resolution mechanism,” said DIS President Prof. Dr. Christoph Schreuer at a press conference in Bonn on Tuesday.
The draft law, which is currently in the consultation phase, provides for a number of changes to the Arbitration Act (SchVG). Among other things, the procedure for the appointment of arbitrators is to be simplified and the possibilities for challenging arbitration awards are to be limited.
Schreuer emphasized that the reform is based on the recommendations of a commission of experts that was set up by the Federal Ministry of Justice in 2022. “The commission’s recommendations were developed in a transparent and inclusive process involving all relevant stakeholders,” said Schreuer.

The Federal Association of German Industries (BDI) also criticized the draft law. “The reform does not go far enough to strengthen the role of arbitration in international disputes,” said BDI managing director Joachim Lang.
