This instrument is made by the Welsh Ministers under sections 14(1) and (3)(a) of the Road Traffic Regulation Act 1984 (“the 1984 Act”).
Interpretation
In this instrument–
“the A40 Trunk Road” means the A40 trunk road as defined by article 2(1) of the Trunk Roads (Wales) Order 2005;
“the A48 Trunk Road” means the A48 trunk road as defined by article 2(1) of the Trunk Roads (Wales) Order 2005;
“the Order” means the The A48 Trunk Road (Cross Hands Roundabout to South-East of Pensarn Roundabout) and the A40 Trunk Road (Pensarn Roundabout to St Clears Roundabout, Carmarthenshire) (Temporary Traffic Restrictions and Prohibition) Order 2024;
“the works” means the works that are the subject of a notice under section 278(8) of the 1984 Act which are described in that notice as “A40 dual carriageway construction between Pensarn and St Clears”;
“the relevant road” means the sections of the A40 Trunk Road and the A48 Trunk Road specified in article 5;
“the Trunk Roads Order” means the Trunk Roads (Wales) Order 2005.
Application
- This Order applies to the relevant road.
Temporary Prohibition and restriction of traffic
- (1) The Welsh Ministers prohibit all traffic (except vehicles excepted under article 3) from entering or proceeding on the relevant road.
(2) The Welsh Ministers temporarily restrict the use of the relevant road by vehicles–
(a) of a weight exceeding 7.5 tonnes, and
(b) of a width exceeding 2.9 metres.
Exceptions
- Article 2 does not apply to–
(a) any vehicle being used in connection with the works,
(b) any vehicle being used for police, fire and rescue, ambulance or national security purposes,
(c) any vehicle being used for the purposes of any public utility undertaking or any statutory undertaker in the exercise of the functions of the undertaker,
(d) any vehicle being used for the purposes of agriculture, construction or forestry (including vehicles used for the conveyance of timber and vehicles used for the conveyance of materials to and from construction sites, construction operations and forestry operations),
(e) any vehicle being used for the conveyance of goods or materials not exceeding 7.5 tonnes and not exceeding 2.9 metres in width,
(f) any vehicle being used for the conveyance of livestock,
(g) any vehicle being used for the conveyance of children to or from school,
(h) any vehicle being used for the conveyance of disabled persons,
(i) any vehicle being used for the conveyance of wheelchairs with persons in them,
(j) any vehicle being used in connection with a funeral,
(k) any vehicle being used for the conveyance of domestic refuse within the limits of the relevant road controlled by the relevant local authority,
(l) any vehicle being used for the conveyance of gritting materials for the purpose of combating ice or snow within the limits of the relevant road controlled by the relevant local authority,
(m) any vehicle being used for the conveyance of food to and from markets,
(n) any vehicle being used for the conveyance of drugs or medical supplies to and from hospitals or surgeries within the limits of the relevant road controlled by the relevant local authority,
(o) any vehicle being used for the repair or maintenance of the relevant road or for the inspection of the relevant road for that purpose, and
(p) any vehicle being used in accordance with a requirement imposed by or under any enactment or by or under the condition of a licence granted under any enactment.
Diversions
- (1) During the period of the prohibition specified in article 2(1) any traffic that would otherwise use the relevant road may proceed along the alternative route specified in article 4(2) if it is reasonable to do so.
(2) The alternative route is–
(a) for traffic travelling from the direction of Carmarthen towards St Clears via the A40 Trunk Road, the B4312 (Pencader Road) to the roundabout with the A4066, the A4066 to the roundabout with the B4302, the B4302 to the roundabout with the A40, and then the A40 to the exit slip for St Clears;
(b) for traffic travelling from the direction of St Clears towards Carmarthen via the A40 Trunk Road, the A40 to the exit slip for the B4302, the B4302 to the roundabout with the A4066, the A4066 to the roundabout with the B4312 (Pencader Road), and then the B4312 (Pencader Road) to the roundabout with the A40;
(c) for traffic travelling from the direction of Cross Hands towards St Clears via the A48 Trunk Road, the A48 to the roundabout with the A476, the A476 to the roundabout with the B4297, the B4297 to the roundabout with the B4312 (Pencader Road), and then the B4312 (Pencader Road) to the roundabout with the A40, and then the A40 to the exit slip for St Clears;
(d) for traffic travelling from the direction of St Clears towards Cross Hands via the A48 Trunk Road, the A40 to the exit slip for the B4312 (Pencader Road), the B4312 (Pencader Road) to the roundabout with the B4297, the B4297 to the roundabout with the A476, and then the A476 to the roundabout with the A48.
Duration and coming into force
- (1) The prohibition and restriction in article 2 continues in force from 11pm on 29th December 2024 until 6am on 30th December 2024.
(2) This Order comes into force on 29th December 2024.
