Bury director jailed after failing to produce accounts for company which owed more than £200,000 in tax

A Bury director has been jailed after failing to produce accounts for his company, which owed more than £200,000 in tax.

Nicholas Rothwell, of Bury, was sentenced to 16 months in prison at Minshull Street Crown Court on Friday 28 October 2024.

Rothwell was the director of Bury-based company, Rothwell Roofing Limited, which traded as a roofing contractor.

An investigation by HM Revenue and Customs (HMRC) found that Rothwell failed to produce accounting records for the company for the period 1 June 2013 to 31 May 2016.

As a result, HMRC was unable to calculate the correct amount of tax that the company owed.

Rothwell was interviewed by HMRC officers on a number of occasions and was given several opportunities to provide the missing records.

However, he failed to do so and was subsequently charged with three offences under the Taxes Management Act 1970.

Rothwell pleaded guilty to the offences at an earlier hearing.

HMRC’s Assistant Director, Fraud Investigation Service, Andy Magill, said:

“Rothwell’s actions were a deliberate attempt to evade his tax obligations.

“By failing to produce the correct records, he made it impossible for HMRC to calculate the correct amount of tax that his company owed.

“This is a serious offence and we will not hesitate to take action against those who try to cheat the taxpayer.”
